2.1 Account Requirement

You must create an account to use MinzyAI. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete. You agree to maintain and promptly update your account information to keep it accurate and current.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may request account deletion by contacting us through our contact form at hello@minzy.ai. Upon account termination, you will lose access to all data and content associated with your account.

3.1 How MinzyAI Works

MinzyAI provides an AI-powered platform where users can:

• Upload a child's drawing (one drawing per session)
• Select an artistic style for transformation
• Generate AI-enhanced images based on the uploaded drawing
• Select products to apply the generated image to
• Purchase physical products or download digital files

3.2 Image Generation and Pricing

Each time you click "Generate", our AI creates 2 unique images based on your uploaded drawing and selected style. Each user receives 2 free generations per session (resulting in 4 total images). Starting from the third generation onwards, each additional generation will incur a charge of RM3.00. This generation fee will be added to your cart and charged at checkout along with any product purchases. Generation fees are charged regardless of whether you are satisfied with the results. We recommend using your free generations to test different styles before purchasing additional generations.

3.3 Available Products

MinzyAI offers the following products featuring your AI-generated images:

• Mugs
• Ceramic Tiles
• Canvas Prints
• Magnets
• Button Badges
• Tote Bags
• Stickers
• Digital Download (high-resolution image file)

Each product has its own pricing, which will be clearly displayed on our platform. There is no limit to the number of products you can order.

3.4 Session Limitations

Each session allows you to upload only one drawing. To work with a different drawing, you must start a new session. This limitation ensures optimal processing and quality control.

3.5 Technical Requirements and File Specifications

To ensure optimal processing and quality results, uploaded drawings must meet the following requirements:

• Accepted file formats: JPG, PNG, GIF, and WebP image formats
• Maximum file size: 20 MB per image
• Recommended: Clear, well-lit photographs or scans of drawings
• Images should contain only the drawing itself without identifying information such as faces, names, or personal details visible in the background

Files that do not meet these requirements may be rejected by our system or may produce suboptimal results. We reserve the right to refuse processing of any file that does not meet our technical specifications.

4.1 Intended Use

MinzyAI is designed for adults (parents, guardians, teachers, or family members) to upload and transform children's drawings created by their own children, students, grandchildren, nieces, nephews, or other children for whom they have proper authority and consent.

4.2 Prohibited Content

You agree not to upload, generate, or use the Service for any content that:

• Contains or depicts nudity, sexual content, or sexually suggestive material involving minors
• Promotes, glorifies, or depicts violence, abuse, or harm to children or any individuals
• Infringes on any third party's intellectual property rights, including copyright, trademark, or patent rights
• Contains hate speech, discriminatory content, or promotes harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Promotes illegal activities, including drug use, terrorism, or criminal behavior
• Contains malicious code, viruses, or any technology designed to harm or disrupt the Service
• Violates any applicable local, state, national, or international law or regulation
• Is defamatory, fraudulent, deceptive, or misleading

4.3 Child Safety and Privacy Protection

For the safety and privacy of children, you must ensure that uploaded drawings:

• Do not contain photographs or recognizable images of children's faces
• Do not include children's names, ages, addresses, school names, or any other personally identifiable information
• Contain only the child's artwork itself, photographed or scanned against a neutral background
• Are uploaded by an adult with proper authority and consent to use the child's artwork

This ensures that children's drawings are processed securely through our enterprise-grade AI processing (Google Gemini API) without any associated personal information. Your drawings are not used to train global AI models.

4.4 Consequences of Violation

We reserve the right to review any content uploaded to our Service. If we determine, in our sole discretion, that content violates these Terms, we may immediately remove the content, suspend or terminate your account, refuse to fulfill any pending orders, and report the violation to appropriate authorities. We may also retain evidence of violations for legal purposes.

5.1 Ownership of Uploaded Drawings

You represent and warrant that you have the right to upload the drawings you submit to MinzyAI. You retain all ownership rights to the original drawings you upload. By uploading a drawing, you grant MinzyAI a non-exclusive, worldwide, royalty-free license to use, reproduce, and process the drawing solely for the purpose of providing our Services to you.

5.2 Ownership of AI-Generated Images

Once an AI-generated image is created from your uploaded drawing, you own the rights to that AI-generated image. However, the AI-generated images are for personal, non-commercial use only. This includes:

• Family keepsakes and home decoration
• Personal gifts
• Personal social media sharing
• Printing additional products for personal use through other services

Commercial use is not permitted without a separate license. This includes, but is not limited to, selling products featuring the AI-generated images, using the images in advertising or marketing materials, or any other commercial or business purpose. For commercial use, bulk use, or institutional use (such as schools, kindergartens, corporations, or organizations wishing to use multiple AI-generated images), please contact us at hello@minzy.ai to discuss appropriate licensing arrangements. Commercial licenses are evaluated on a case-by-case basis depending on scope of use, distribution, and duration of the license.

While not required, we kindly encourage you to credit or tag MinzyAI when sharing your AI-generated images on social media or other public platforms. This helps other families discover our service.

5.3 Marketing and Promotional Use

We may request your permission to use your uploaded drawings or AI-generated images for marketing, promotional, or testimonial purposes on our website, social media, and other marketing materials. Such use will only occur with your explicit consent, which you may grant or withhold at your discretion. You may revoke this consent at any time by contacting us at hello@minzy.ai.

5.4 MinzyAI Intellectual Property

The MinzyAI platform, including all software, algorithms, designs, logos, trademarks, and other intellectual property, is owned by MinzyAI or our licensors. These Terms do not grant you any rights to use our intellectual property except as necessary to use the Service as intended.

7.1 Pricing and Payment Processing

All prices are displayed in Malaysian Ringgit (RM) and include applicable taxes. We use Stripe as our payment processor. Payment information is processed securely by Stripe and is not stored on our servers. By making a purchase, you agree to Stripe's terms of service and privacy policy.

7.2 Generation Fees

Each generation produces 2 AI-enhanced images. You receive 2 free generations per session. Starting from the third generation onwards, additional generation fees (RM 3.00 per generation) are charged at checkout along with any product purchases. These fees are non-refundable once the images have been generated.

7.3 Authorization and Billing

By providing payment information, you authorize us to charge the applicable fees to your selected payment method. You represent and warrant that you have the legal right to use the payment method you provide. If payment cannot be processed, we reserve the right to suspend or cancel your order.

8.1 Order Confirmation

Once you place an order, you will receive an order confirmation email containing details of your purchase. This confirmation does not constitute acceptance of your order but merely acknowledges that we have received it. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

8.2 Order Cancellation

Due to the personalized nature of our products and the immediate commencement of production upon order placement, we do not accept order cancellations. All sales are final once an order is confirmed. Please review your order carefully before completing your purchase.

8.3 Shipping and Delivery

Physical products are typically shipped within 5 to 7 business days from the date of order confirmation. Once shipped, delivery time will depend on your location within Malaysia and the courier service used. Total delivery time may be affected by factors beyond our control, such as courier delays or public holidays. You will receive tracking information once your order has been shipped. Digital downloads are available immediately after purchase.

8.4 Delivery Area

We currently only deliver within Malaysia. International shipping is not available at this time.

8.5 Shipping Address

You are responsible for providing accurate and complete shipping information. We are not responsible for orders delivered to incorrect addresses provided by you. In cases where a package is returned due to an incorrect address provided by you, we reserve the right to either: (a) arrange re-delivery upon payment of additional shipping fees, or (b) issue a refund minus the original shipping costs and any applicable restocking fees.

9.1 No Returns or Exchanges

Due to the personalized and custom nature of our products, we do not accept returns or exchanges. Each product is made specifically for you based on your uploaded drawing and selected design, making it unsuitable for resale or reuse.

9.2 Defective or Damaged Products

If your product arrives damaged or defective due to manufacturing or shipping issues, please contact us at hello@minzy.ai within 7 days of delivery with photographic evidence of the damage or defect. We will review your claim and, at our sole discretion, may offer a replacement product or refund.

9.3 Production Quality

We strive to ensure the highest quality in all our products. However, please note that colors and image quality may vary by approximately 10-15% from screen display due to differences in monitor settings, printing processes, and material properties. Such variations are not considered defects and are not grounds for returns or refunds.

11.1 Service Provided "As Is"

The MinzyAI Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

11.2 AI-Generated Content Disclaimer

AI-generated images are created by artificial intelligence algorithms based on your uploaded drawings and selected styles. The output may vary and may not always match your expectations. We do not guarantee specific results or artistic outcomes. You acknowledge that AI technology has limitations and that the generated images may occasionally contain unexpected elements or variations.

Results may vary depending on the complexity, clarity, and style of the original drawing. Certain types of drawings (such as those with clear lines, simple compositions, and good contrast) typically produce better AI transformation results than complex, faded, or unclear drawings.

11.3 Customer Satisfaction and Regeneration

If you are dissatisfied with the AI-generated results during your free generation quota (first 2 generations), you may continue to regenerate images at no additional cost until you have exhausted your free quota. After exhausting the free quota, each additional regeneration will incur the standard RM 3.00 fee.

Once you have selected an AI-generated image and proceeded to order products, you acknowledge that you are satisfied with that particular image. No refunds or regenerations will be provided after product orders have been placed based on concerns about the AI-generated image quality or appearance.

11.4 Limitation of Liability

To the fullest extent permitted by applicable law, MinzyAI, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any interruption or cessation of transmission to or from our Service

In no event shall MinzyAI's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to MinzyAI in the six months preceding the claim.

11.5 Account Security and User Responsibility

You are solely responsible for maintaining the security of your account credentials. In the event of unauthorized access to your account due to your failure to maintain adequate security, you agree that MinzyAI shall not be held liable for any resulting damages, unauthorized purchases, or compromised data. You must immediately notify us of any suspected security breach or unauthorized use of your account.

11.6 Indemnification

You agree to indemnify, defend, and hold harmless MinzyAI and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date at the top of this document. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

12.2 Changes to Service

We may modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any features, database, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

12.3 Force Majeure

MinzyAI shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. In such events, our performance will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume performance as soon as practicable.

13.1 Electronic Communications

By using MinzyAI, you consent to receive electronic communications from us, including emails regarding your orders, account updates, promotional materials (if you have opted in), and important notices about our Terms or Privacy Policy. These electronic communications are considered to satisfy any legal requirement that such communications be in writing.

13.2 Maintaining Accurate Contact Information

You are responsible for maintaining an accurate and current email address in your account settings. All official notices and communications will be sent to the email address on file. We will not be held liable for any consequences arising from your failure to receive important notifications due to an outdated or incorrect email address.

13.3 Data Breach Notification

In the unlikely event of a data breach that affects your personal information, we will notify you via email within 72 hours of confirming the breach, in accordance with the Personal Data Protection Act 2010 (PDPA) requirements. The notification will include information about the nature of the breach, the data affected, and the steps we are taking to address the situation.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Selangor, Malaysia. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14.3 Dispute Resolution

Before filing any formal legal action, you agree to first contact us at hello@minzy.ai to attempt to resolve any dispute informally. Most disputes can be resolved quickly and amicably through direct communication.

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MinzyAI regarding the use of our Service and supersede all prior agreements and understandings, whether written or oral.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of MinzyAI.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms are for the benefit of, and will be enforceable by, the parties only. These Terms are not intended to confer any right or benefit on any third party.
